Event Participation in Dreaming On in California Activation

EVENT NAME:  Dreaming On In California (hereinafter the “Event”)

EVENT DATE(s): June 20-26

In consideration of Participant being allowed to participate in the Event, Participant hereby acts for Participant, Participant’s executors, administrators, heirs, next of kin, successors, and assigns as follows:

Photo and Media Release

By your participation in this Event, including through the submission of any materials to Visit California (hereafter the “Company”), Company is granted unrestricted the rights to use any images from the Event for promotional use on websites, portfolio, blog submissions, media features, advertisements or flyers. The Participant hereby grants the Company the permission to do so without any financial compensation or prior notice to the Participant, and Company is hereby granted a perpetual, irrevocable, royalty-free, worldwide license to any and all intellectual property rights which might exist in any content submitted by Participant. The Participant may not use any of the professional images sent from the Company photographer or any other participating photographers for commercial use without written permission from the photographer and Company.

Name and Likeness

Participant hereby grants Company a perpetual, irrevocable, worldwide, royalty-free right to use Participant’s name, image, likeness and other identifying indicia (“Name and Likeness”) in any and all media (now or hereafter known) for Company’s earned media efforts, social media, advertising and marketing purposes, including, without limitation, in connection with the posting, publication and/or any other exploitation of any of the Content, without limitation as to time or territory.

WAIVER OF COMPANY LIABILITY

PARTICIPANT HEREBY ASSUMES ALL OF THE RISKS OF PARTICIPATING IN ANY/ALL ACTIVITIES ASSOCIATED WITH THIS EVENT, including by way of example and not limitation, any risks that may arise in connection with my participation in this Event. Participant hereby certifies that Participant has no health-related reasons or problems which preclude participation in this Event.

Participant acknowledges that this Terms and Conditions including this Accident Waiver and Release of Liability can be used by Company, who are the organizers of the Event, and that it will govern Participant’s actions and responsibilities at said Event.

(A) PARTICIPANT HEREBY WAIVES, RELEASES, AND DISCHARGES from any and all liability or fault of the entities or persons released, for Participant’s death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to Participant including Participant’s travel to, from and during this Event, THE FOLLOWING ENTITIES OR PERSONS:  Company (Visit California) and/or its directors, officers, employees, volunteers, representatives, and agents, and any other activity sponsors or partners including, but not limited to, destination representatives and attraction, rental car, accommodations or any such other parties acting with or at the direction of Company in connection with the Event.

(B) PARTICIPANT WILL INDEMNIFY, HOLD HARMLESS, AND HEREBY COVENANTs NOT TO SUE Company and/or any other parties acting together with or at the direction of Company from any and all liabilities or claims made as a result of Participant’s participation in the Event and any activities related thereto.

Participant acknowledges that Company and its directors, officers, volunteers, representatives, and agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf, or present as participants in the Event.

Participant acknowledges that this Event may involve risks including, but not limited to, those caused by terrain, facilities, temperature, weather, condition of other participants, illness of Participant or others participating in the Event, equipment, driving on public highways, vehicular traffic, and actions of other people. These risks are hereby acknowledged by Participant as inherent to the activities associated with this Event.

Participant hereby consents to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this Event.

The Accident Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

By signing below participant certifies that participant has read this document and fully understands its content. Participant is aware that this is a release of liability and a contract and participant signs it of participant’s own free will.

COVID-19 Acknowledgment and Waiver

Participant acknowledges the contagious and potentially lethal nature of the COVID-19 virus (or any such other contagion as might be present) and voluntarily assumes the risk of exposure or infection by COVID-19 while participating in Event.

Participant agrees that this Release includes any claims based on the actions, omissions, or negligence of Visit California and its destination and hospitality partners, whether a COVID-19 infection occurs before, during, or after the visit.

Participant acknowledges and agrees to take appropriate precautions while in California, including maintaining vigorous personal hygiene, including frequent hand washing and/or hand sanitizing; practicing social distancing from persons not living in the same household; and to follow all such other instructions as may be provided by the California Department of Public Health, the Centers for Disease Control, or such other local health authority. 

Participant states that if Participant experiences any symptoms of COVID-19 or any other communicable disease(s) including without limitation those diseases identified by the Centers for Disease Control and/or California Department of Public Health, or has a fever, feels feverish or exhibits any other symptoms, within 72 hours prior to the start of the visit, Participant will notify Company immediately.

Participant is responsible for obtaining all necessary travel documents required to lawfully enter and remain in California and will be in possession of the appropriate documents at all times while present in the State.

The Event may include participation in various activities. It is the responsibility of the participant to ensure Participant is medically fit and competent to participate in these activities. If the Participant has any doubts, it is the Participant’s responsibility to bring them to the attention of Visit California beforehand.

The Participant agrees to abide by Visit California’s Responsible Travel Code which is incorporated herein by reference.

I hereby certify that I am over the age of 18 and have the ability and authority to sign this agreement and hereby agree to the terms and conditions set forth herein.
